The Chief judge of Osun state, Justice Oyebola Adepele-Ojo, has officially dissolved a 17-year old marriage between Iyanda Oluwaseun and Iyanda Ayodeji, citing a total breakdown of the union due to the husband’s irresponsible behavior.
The petitioner, Oluwaseun, has approached the court seeking an order of dissolution under Section 15(1) of the Matrimonial Causes Act. Through her counsel, D.D. Awoyemi, she argued that her husband’s conduct had become unbearable and that the marriage had been effectively dead since 2021.
The union, which began on September 22, 2009, at a Lagos registry, produced three children. However, the court heard that the couple had been living apart for three years prior to the commencement of the legal proceedings.
In her judgement delivered on Wednesday, Justice Omo noted that the marriage was effectively irretrievable. Evidence presented during the proceedings confirmed that both parties have been living separately for three years before the filing of the suit.
Furthermore, the court upheld the petitioner’s claims of emotional and verbal abuse. Justice Ojo pointed out that the respondent failed to provide evidence to debunk the allegations of his irresponsible behavior and verbal mistreatment of his wife.
Concluding that the marriage had reached a point of no return, the court ruled in favor of the petitioner. The marriage was formally dissolved and full custody of the three children was granted to Oluwaseun as she wanted.
